Judge rules 2 Americans accused in Carlos Ghosn escape can be extradited to Japan - MSN Money

The two men arrested in Massachusetts on suspicion of smuggling auto bigwig Carlos Ghosn out of Tokyo can be extradited to Japan, a federal judge ruled Friday.

Michael Taylor, 59, and his son Peter Taylor, 27, were arrested in May. Prosecutors alleged they concealed Ghosn in a large black box and carried him out of a high-rise hotel in Japan in his escape from the Japanese justice system late last year.

Lawyers for the Taylors argued in U.S. court that the pair didn’t break Japanese law.

Magistrate Judge Donald Cabell said in court papers filed Friday that he was bowing to the precedent of U.S. judges deferring to foreign authorities’ interpretations of their own laws.

“Even assuming an extradition court has both the authority to resolve disputed issues of foreign law, and the hopeful belief it could do so competently, that does not mean it should,” Cabell wrote in an 11-page order.

The U.S. Secretary of State has final say on the matter.

Ghosn traveled to Lebanon on private planes as he fled charges of financial wrongdoing in Japan. Now facing an Interpol red notice, he has professed his innocence in the case. (Japan and Lebanon don’t share an extradition treaty.)

Michael Taylor, a former Green Beret, was arrested with his son on May 20 in Harvard, Mass.

Paul Kelly, a lawyer for the Taylors, said in a statement: “We had hoped the Court would not simply defer to Japan’s request but understand the limited role of the judiciary in extradition matters.”

In his statement, Kelly urged the State Department to “consider the heroism and courage of Michael Taylor” and his work with U.S. law enforcement.
