Businesses looking for limited COVID-19 liability as bills stall - Jacksonville Journal-Courier

Business groups are looking for Illinois lawmakers to provide limited liability from COVID-19 lawsuits, but efforts to bring about such protections have stalled in committee.

Many states across the country have measures in place that limit the liability for a business to be sued if someone alleges they contracted COVID-19 at that business.

The American Tort Reform Association indicates across the country 9,594 complaints related to COVID-19 have been filed. Through most of 2020, the group also tracked 176,053 television advertisements in the United States for legal claims or services mentioning COVID-19. More than $1 million of the $3.1 million spent was in Illinois, according to the group.

Illinois Hotel & Lodging Association President Michael Jacobson said Illinois needs to join other states and offer liability protection, or the state will lose business to other states.

“Businesses who follow government guidelines for safe operations and implement best practices to prevent the spread of COVID-19 should be protected from legal liability,” Jacobson told a House committee.

The Illinois Trial Lawyers Association said there shouldn’t be blanket liability protections, and workers and consumers should be protected from bad actors.

“If businesses are taking the proper precautions to protect employees and customers, they won’t have to worry about potential lawsuits because negligence claims are governed by a reasonableness standard,” said Larry R. Rogers Jr., president of the Illinois Trial Lawyers Association. “Consumers don’t want to shop or dine in establishments that cut corners on safety, nor do the men and women who staff these businesses want to work without the confidence that everything reasonably possible has been done to keep everyone safe and healthy.”

Illinois Manufacturers’ Association President Mark Denzler said in an interview they’re not seeking blanket immunity. They are looking to stem “frivolous lawsuits.”

“They could be completely innocent and have followed all protocols and they may spend tens of thousands of dollars defending themselves from frivolous claims,” Denzler said.

Bills filed by Republicans in the House and Senate to offer limited liability protections for businesses that may be hit with COVID-19 lawsuits have stalled in committee.

Total cases in west-central Illinois counties as of Tuesday, according to individual county health departments, and vaccination rates, according to the Illinois Department of Public Health, were:

Brown County

684 total, 673 recovered, seven deaths

Fully vaccinated: 19.02%; 65 or older: 68.24%

Cass County

1,951 total, 1,907 recovered, 33 deaths

One new case.

Fully vaccinated: 29.68%; 65 or older: 69.74%

Greene County

1,403 total, 1,337 recovered, 48 deaths

Fully vaccinated: 22.23%; 65 or older: 55.78%

Jersey County

2,585 total, 2,513 recovered, 48 deaths

Fully vaccinated: 26.64%; 65 or older: 74.72%

Macoupin County

4,720 total, 4,394 recovered, 110 deaths

Seven new cases.

Fully vaccinated: 25.51%; 65 or older: 72.53%

Morgan County

3,821 total, 3,683 released from restrictions, 101 deaths

Four new cases.

Fully vaccinated: 26.77%; 65 or older: 73%

Pike County

1,725 total, 1,670 recovered, 47 deaths

Fully vaccinated: 23.02%; 65 or older: 62.37%

Sangamon County

17,479 total, 228 deaths

48 new cases.

Fully vaccinated: 31.07%; 65 or older: 79.94%

Schuyler County

667 total, 650 recovered, 16 deaths

One new case.

Fully vaccinated: 27.2%; 65 or older: 65.5%

Scott County

468 total, 460 recovered, one death

Three new cases.

Fully vaccinated: 22.03%; 65 or older: 60.98%

Statewide, 3,193 new cases of coronavirus disease and 17 deaths were reported Tuesday, according to the Illinois Department of Public Health.

There have been 1,285,398 cases and 21,540 deaths in Illinois.
